The new no fault divorce law takes effect today

From today, individuals will no longer be able to allege fault in the application for divorce.

The new no fault divorce law has come into effect today, and there is no longer a requirement to allege “unreasonable behaviour” or “Adultery” until a couple have been separated for more than two years.

This will hopefully prove helpful to those couples who wish to divorce immediately following separation, but who don’t want to have to make allegations against the other party. The new no fault system will hopefully also prove beneficial for children because their parents can divorce without making fault based allegations.

It will also be possible for both parties to make a joint application for divorce.
